Clause 1: Applicability, conclusion of contract
(1) douriez, having its head office in Nahariya, offers services in particular via its online store at https://virtual-server-personal.com/ and via the customer portal integrated into the online store
(2) These general conditions apply to all contracts concluded between the supplier and the customer via the online store as well as to all contracts for which the applicability of these GTC has been agreed between the parties other than via the online store.
(3) Deviating, conflicting or additional general conditions of a customer do not become part of the contract, unless this has been expressly agreed in writing. The same applies if the service is carried out knowing that this contravenes the corresponding General Terms and Conditions in force with the customer.
(4) Individual agreements concluded between supplier and customer, e.g. during the ordering process, take precedence over these T&Cs in the area of individually agreed contractual conditions and are supplemented by these T&Cs.
(5) The range of services offered in the online store is intended for consumers and businesses, unless otherwise stated in the online store. A “consumer” means any natural person who enters into a legal transaction for purposes which are primarily not within his or her commercial, business or professional activity. “Company” means a natural person or a legal person or a partnership with legal personality which, when concluding a legal transaction, acts in the exercise of its commercial, economic or professional activity

(7) By clicking on the “Order” button in the online store, the customer makes a binding purchase offer. Immediately after making said purchase offer, the customer will receive an email confirming receipt of the order. However, the order confirmation does not yet constitute acceptance of the purchase offer. The contract will only be concluded after receipt by the customer of another e-mail containing access data to the ordered service.
(8) Contracts are concluded in English.
(9) The agreed contractual provisions will be retained by the service provider.
(10) The supplier reserves the right to modify these General Terms and Conditions to the extent necessary in order to adapt them to the changed legal or technical framework conditions. The supplier will inform the customer of these modifications by e-mail, the modified passages being highlighted. All changes will be considered approved unless Customer objects in text form within six weeks of receipt of notification of the changes. Along with notification of the changes made, the Supplier will also provide the Customer with separate instructions on the right to object and the legal consequences of silence.
